Patrick Lowther is a Partner in the firm’s Litigation Practice.  Mr. Lowther has significant experience representing clients in a wide variety of complex litigation matters throughout the United States, including class action cases, product liability cases, general commercial disputes, real estate related matters, personal injury matters, and bankruptcy matters. 

Mr. Lowther has litigated cases in numerous state and federal courts across the country.  He also has significant appellate experience in state and federal court. 

Mr. Lowther also enjoys representing clients pro bono in a broad range of civil and criminal matters. In addition, Mr. Lowther is the Chair of the firm's corporate social responsibility initiative, MMMPact, and MMM’s Community Involvement Program. He is also on the Executive Council for the Alabama State Bar Non-Resident Section.     

Representative Experience

  • National coordinating counsel for real estate development and hospitality management company and its affiliates in connection with defense of over 100 lawsuits, including multiple putative class actions and multi-party suits, filed in state and federal courts nationwide arising from development of residential resort communities.
  • Represented one of country’s largest home improvement retailers in connection with defense of multidistrict products liability litigation involving over 50 lawsuits filed by over 200 plaintiffs in federal courts nationwide alleging respiratory related injuries arising from their alleged exposure to an aerosolized grout sealant.
  • Defended multiple e-cigarette / vaping companies involved in the manufacture, distribution, and sale of devices against product liability claims in connection with lawsuits filed in state and federal court around the country.
  • Represented various financial services companies in connection with lawsuits in state and federal court around the country alleging violations of state and federal statutes, including Fair Credit Reporting Act, Fair Debt Collection Practices Act, Truth in Lending Act, and Telephone Consumer Protection Act.
  • Represented global tire manufacturing company in connection with defense of multiple lawsuits alleging nuisance and trespass claims.
  • Defended non-profit organization in lawsuit alleging trespass and related condemnation proceeding arising from construction of facility.
  • Currently representing provider of medical devices and its affiliates in connection with lawsuit alleging breach of contract and conversion claims.
  • Defended national provider of wellness benefits in putative class action arising from sale of health insurance to consumers nationwide.
  • Represented real estate company in lawsuit arising from lease agreement dispute relating to land on which telecommunications tower was located.
  • Defended one of the largest manufacturers of various containers in North America in premises liability/personal injury lawsuit.
  • Represented plaintiff in premises liability/personal injury lawsuit against hotel.
  • Defended seller of medical devices in product liability case.
  • Defended real estate company in dispute involving alleged injuries resulting from mold exposure.
  • Represented one of country’s largest fruit and vegetable distributors in lawsuit seeking to recover amounts owed under the federal Perishable Agricultural Commodities Act.
