Commerce Reduces Steep Duties in Quartz Countertops Case for MMM Client

The U.S. Department of Commerce made a significant change between the Preliminary Results and the Final Results in the first antidumping duty administrative review of Quartz Surface Products from India that resulted in a huge victory for MMM client, the Federation of Indian Quartz Surface Industry. Commerce originally applied a 161.56 percent all others dumping rate to many members of MMM client the Federation of Indian Quartz Surface Industry. Such rate was the average of a 0.00 rate calculated for one mandatory respondent and a 323.12 percent adverse facts available rate applied to one mandatory respondent that missed a Commerce deadline. Through counsel of MMM's Trade Group, spearheaded by Julie Mendoza and E.J. Thomas, the Federation of Indian Quartz Surface Industry argued that the 161.56 percent rate applied to the 51 non-selected companies was not “reasonably reflective” of the non-selected companies’ potential dumping margins during the POR.  Commerce agreed with the Federation for the Final Results and reduced the dumping margin applied to non-selected companies to 3.19 percent.
