A Turkish steel pipe producer MMM represents has scored a significant victory in the U.S. Court of Appeals for the Federal Circuit. The three-judge panel ruled on August 26 that the U.S. Department of Commerce should not have adjusted for what is known as a "particular market situation”, or PMS, when it first calculated tariffs. International Trade Group Partner Julie Mendoza led the team representing the steel pipe producer – Borusan Mannesmann Boru Sanayi ve Ticaret A.S. She told Law360 that the client is pleased that after many years the case is finally decided. She added it’s also pleased it won’t have to pay anti-dumping and countervailing duties.
