Joe Berklund is Co-Chair of the Emerging Companies / Venture Capital practice and the firm's Florida Practice Leader. Joe’s practice includes representing venture backed and backable emerging companies, private equity backed companies and leading venture, growth equity, and private equity funds in financing and M&A transactions. 

In working with emerging technology companies, Joe also regularly serves as general outside counsel, utilizing specialists across MMM as needed to deliver legal advice in key areas affecting scaling businesses, including executive compensation and stock options, licensing, technology transfer and customer agreements, data and privacy, tax, employment and intellectual property. Joe also works with clients to add value in other ways through his network and the MMM ecosystem, including making introductions to capital sources, advisors, board members and other individuals and groups that can be resources to growing businesses.

Prior to joining MMM, Joe was a Venture Capital Associate with Duke Capital Partners. Prior to Duke, Joe specialized in high-stakes, complex business litigation in Miami, Florida. Joe often leverages his prior litigation experience in counseling clients regarding corporate governance matters, potential disputes and to mitigate potential litigation risk. Before practicing law, Joe worked in real estate-based debt origination.

  • Represented Coin Ledger in $6M financing with investors from  CMT Digital, DRW Venture CapitalFinTech CollectiveVolt CapitalVoyager Digital Ltd. (TSX: VOYG) (OTCQX: VYGVF) (FRA: UCD2), Adam White (Co-Founder of Bakkt), and Mike Dudas (Founder of The Block).
  • Represented Sierra Ventures and Tech Square Investors as co-lead investors in Speedscale.
  • Represented FTV as lead investor in $35M growth equity financing of Derivative Path, Inc.
  • Represented FreightWaves in its $20 million Series B funding round led by 8VC, Revolution, Hearst Ventures and others.
  • Represented FTV as lead investor in a $28M growth equity financing of OpenSesame, Inc.
  • Represented Fulcrum Equity Partners in $26M investment in Stratasan, LLC also involving investments by Frist Cressey Ventures and Blue Heron Capital.
  • Represented AnalyticsIQ in a growth investment (amount not disclosed) by Boathouse Capital. 
  • Represented Phishlabs in a $20.5M growth equity financing led by LLR Partners and others.
  • Represented FreightWaves in its $13 million Series A funding round led by 8VC, Fontinalis Partners and others.
  • Represented Ideas United in a $15M growth equity financing led by Kayne Anderson Capital Advisors, LP.
  • Represented Cortera in $10M Series B funding round led by Hearst Ventures and others.
