Chubb-Archdiocese Suit Raises Coverage Burden Issues

MMM’s Seslee Smith and Ryan Burke were recently quoted in an article regarding a Chubb Insurance lawsuit against the Archdiocese of New York over indemnity for sexual abuse claims.

Chubb has repeatedly accused the Archdiocese of New York of obstructing the insurer’s attempts to collect information that could show whether the church’s conduct concerning the abuse claims would qualify as a covered accident. Following a trial court ruling against it, Chubb is seeking to revive the lawsuit through an appeal before the First Judicial Department of the New York Supreme Court. Smith explains that Chubb is likely appealing due to the order being “quite short” and not as “well-reasoned as it could have been.” Chubb’s counsel indicated that the carrier was filing the suit to obtain information about the church’s potential knowledge of the alleged abuse. Burke explains that this is “notable” and that an insurer “would typically not want to file litigation just for the purpose of gathering information because it could air the dirty laundry of your insured.”
