Bruce C. Smith is a senior partner and head of the Construction Practice. Mr. Smith’s practice encompasses the complete spectrum of construction and environmental matters and issues. Mr. Smith is also a senior member of the Environmental Practice. His practice focuses on the following aspects of construction and environmental law and litigation: environmental due diligence and assessment; construction and environmental permits and entitlements; reviewing, drafting and negotiating design, engineering, procurement and construction contracts and environmental agreements, including government contracts for services and products; federal, state and local procurement matters including bid protests, claims and litigation before federal, state and local agencies, boards and courts; all construction and environmental aspects of Brownfield redevelopment and mixed-use development projects (including all construction issues associated with the Atlantic Station project, the nation’s largest Brownfield redevelopment project); and handling construction and environmental issues, disputes and litigation relating to all types of government protests and contracts and retail, residential, commercial, hospitality, resort, mixed-use, industrial, warehouse, Brownfield, infrastructure, utility, transportation, roadway and airport facilities and projects. Mr. Smith’s practice also embraces the design, development and construction of new, clean and/or renewable energy facilities and projects including LEED™ certified and other sustainable development projects.
Mr. Smith has served as an adjunct professor at the Georgia Institute of Technology in construction law and is a recognized national speaker on a variety of construction and environmental topics. Mr. Smith is an AV rated lawyer by Martindale Hubbell and has been honored as a “Georgia Super Lawyer” by Atlanta Magazine. Mr. Smith has written numerous articles on construction and environmental topics and has appeared on local Atlanta television programs as a recognized commentator on both construction and environmental issues.
Recent Experience
- Represented owner/developer of the Atlantic Station mixed-use project in Atlanta, Georgia (the largest mixed-use Brownfield redevelopment project in the United States) in drafting and negotiating design, engineering and construction contracts and in construction claims and litigation relating to the project.
- Represented major international technology company in bid protest litigation which successfully affirmed the award of the $391 million contract for the new state of Georgia Medicaid Management Information System.
- Represented national prime contractor in negotiating construction contracts and construction claims and handling litigation arising out of various federal projects located in Washington, D.C., Mayport, Florida and Chattanooga, Tennessee.
- Represented national owner/developer of retail centers, luxury high-rise condominiums and mixed-use developments on claims and arbitration involving the design and construction of The Wharf at Orange Beach, Alabama (the largest mixed-use marina/resort development in the southeastern United States).
- Represented major national and international hotel and resort developer in drafting and negotiating design and construction contracts and handling claims and litigation relating to multiple luxury destination resorts throughout the United States and the Caribbean.
