OFCCP’s June 30th Deadline Is Approaching – Have You Certified Compliance with the Annual Affirmative Action Plan Requirements?

The deadline for contractors and subcontractors with existing Affirmative Action Plan (AAP) compliance obligations to certify their compliance using the portal operated by the Office of Federal Contract Compliance Programs (OFCCP) is June 30, 2022. The portal can be accessed at contractorportal.dol.gov.

Federal contractors with more than 50 employees and federal contracts or subcontracts in excess of $50,000 must meet gender, race, and disability obligations as set forth in an AAP. AAPs covering veterans are also required for contractors and subcontractors with more than 50 employees and federal supply and service contracts or subcontracts over $150,000. At the end of 2021, OFCCP announced a new requirement to certify AAP compliance through an online portal. Construction contractors are exempt and expressly directed not to register for the new portal.

OFCCP's portal opened for registration on February 1, 2022, and began accepting certifications at the end of March. All covered contractors and subcontractors must certify compliance by June 30th. The deadline is fast-approaching. Covered contractors and subcontractors should ensure that they are prepared for certification and have taken all necessary steps to do so.
