Morris, Manning & Martin Announces Mobile Law & Compliance Group

Atlanta (June 25, 2012) – Morris, Manning & Martin, LLP, an AmLaw 200 firm, has formed a Mobile Law & Compliance Group to address the unique and expanding array of legal and regulatory issues that impact all companies – particularly those adopting a mobile strategy for delivering products and services.

The new practice area advises companies on a broad range of issues associated with mobility including privacy and security, financial regulations, employment law, intellectual property rights and global commerce. The Group will also focus on the potential impact of existing laws such as Gramm-Leach-Bliley, Sarbanes Oxley and HIPAA on the business use of mobile technologies.

“Many of our clients, particularly those in the technology sector, are developing and implementing mobile strategies,” said Sandra Gardiner, co-chair of the MMM Mobile Law & Compliance Group. “The challenge is determining the standard of legal care required to comply with laws and regulations enacted before the growth of mobile technology.” The Group includes attorneys focused on legal areas that are directly applicable to mobility – employee monitoring and mobile positioning, mobile device management (MDM) and confidentiality, financial regulatory, PCI, dispute resolution, technology transactions and contracts, ecommerce and mobile payments.

In establishing the Group, MMM is also offering several services:

  • Mobility Opportunity & Risk Assessment – An assessment of the mobility touchstones in the client’s business and industry, whether or not the client has a defined mobile product strategy. The Group helps to assess the legal implications of mobility unique to a client’s business model and industry.
  • Mobile Law Compliance Program – A compliance program focused on recognizing, managing and reducing the legal and commercial risks associated with mobility for a client’s products and services.
  • Internal Mobility Law Assessment – An assessment of the legal and compliance risks associated with the adoption of mobile devices by a client’s work force, especially in the context of “bring your own device” (where an employer attempts to accommodate multiple, incompatible mobile devices that will store, transmit and process confidential and proprietary data and possibly have access to company applications).
  • Security and Privacy Law Review – A review and analysis of an enterprise’s existing security and privacy policies, documents and agreements and proposed modifications and additions to support the legal issues expected from execution of the mobile strategy by a company in both its internal operations and external deployment.
