Larry Kunin is a partner in the Litigation Practice with a concentration in technology and intellectual property litigation, including software performance, trade secret, trademark and copyright litigation, as well as general commercial and business tort litigation. Mr. Kunin is also available to serve as a special master or mediator in disputes involving technology or e-discovery.
During his career, Mr. Kunin has litigated disputes in state and federal courts in Georgia and Florida, as well as throughout the country. Mr. Kunin’s clients have ranged from large publicly traded technology companies, including Microsoft and McKesson Corporation, to startup companies and individuals. Using his background in the computer field, Mr. Kunin is able to understand and investigate complex technology issues and present such issues to a court, arbitration panel or other dispute resolution forum.
Prior to joining Morris, Manning & Martin in March 2000, Mr. Kunin practiced in Miami, Florida and is a member of the Georgia and Florida Bars. Mr. Kunin gained computer and technology experience while employed as a computer programmer and analyst for The Miami Herald from 1986-92.
Recent Experience
- Evolution, Inc. v. SunTrust Banks, et al (D. Kan.). Represented SunTrust Bank in a copyright, trade secret and breach of contract lawsuit. Obtained summary disposition of copyright and trade secret claims, and then obtained a jury verdict in favor of SunTrust on plaintiff’s claim and SunTrust’s counterclaim.
- Snapping Shoals Electric Membership Cooperative (“SSEMC”) v. Cayenta Canada Corp. (N.D. Ga). Represented SSEMC in software development and implementation dispute.
- FTI Partners v. Goldleaf Enterprise Payments (S.D.N.Y.). Represented Goldleaf in dispute with investment banker and obtained full defense verdict at trial.
- Represent McKesson Corporation in numerous litigation matters on copyright and software license matters. Recently tried arbitration on behalf of McKesson on software royalty claim, which was resolved on confidential terms.
- Represented CES International in disputes related to its utility outage management software prior to its acquisition by SPL Worldgroup.
- Represented software developer and licensor in software performance arbitration, which was resolved on confidential terms.
- Represented insurance company in defense of post-closing indemnification. Obtained full defense award from three person arbitration panel.
- Served as neutral third-party mediator in software implementation and performance dispute. Mediation concluded with successful settlement.
