The SEC has provided relatively little guidance on how investment advisers or their employees may use social media or networking websites, or on the compliance implications of doing so. However, we know these activities are on the SEC's radar given the sweep exam reportedly conducted on social media in early 2011. Recent studies show that nearly 70 percent of asset managers use some sort of social media tool such as Facebook, LinkedIn, or Twitter.1 Are "likes," "recommendations," and "tweets" subject to recordkeeping requirements? Are they considered advertisements? Can investment advisers rely on guidance issued by FINRA for broker-dealers?
