Lisa Wolgast is a partner in the firm’s Creditors’ Rights & Bankruptcy and Corporate & Commercial Litigation Practices. She focuses her practice on creditors’ rights and bankruptcy issues, representing creditors in and out of bankruptcy in state and federal court. Her practice also includes complex commercial litigation and arbitration.

Ms. Wolgast regularly represents creditors in complex workouts, protects creditors’ rights under Chapters 7 and 11 of the Bankruptcy Code, defends lender liability claims, represents creditors in preference and fraudulent transfer claims brought by bankrupt debtors and trustees, and handles complex valuation proceedings. Ms. Wolgast also represents creditors and liquidating agents in fraudulent transfer and preference claims and represents various fiduciaries, including receivers, in the sale of assets.

Ms. Wolgast has practiced in the firm’s Commercial Litigation Practice since joining the firm, and has extensive experience litigating disputes in many areas of the law including creditors’ rights, bankruptcy, healthcare, partnership disputes, and general commercial disputes for local and national clients in federal and state courts. Ms. Wolgast also has experience in complex arbitrations before the London Court of International Arbitration, AAA and JAMS.

  • Representation of creditors' committee and liquidating trustee in bankruptcy cases involving Ponzi scheme
  • Representation of creditors' committee in bankruptcy case of artificial turf manufacturer
  • Representation of lenders in bankruptcy cases of restaurant franchisees
  • Representation of creditors' committee in bankruptcy proceeding filed by automobile dealer and subsequently represented the liquidating agent post-confirmation in connection with his resolution of claims and claims objections and pursuit of fraudulent transfer claims against the former owner
  • Representation of lender in foreclosure confirmation and deficiency suit in $30 million loan secured by condominiums and marina located in Putnam County
  • Representation of lender in note/guaranty suit resulting in $22 million judgment against obligors
  • Representation of lender in bankruptcy court successfully defeating Debtor’s proposed “dirt for debt” plan of reorganization and successfully converted the case to Chapter 7
  • Representation of lender in connection with appointment of receiver and $10 million note/guaranty suit secured by retail strip center
  • Representation of chemical manufacturer in arbitration before the LCIA regarding breach of asset purchase agreement
  • Representation of lender in connection with defense of claims relating termination of swap agreement
