John Lockett is a commercial litigator specializing in high-stakes, situation-specific disputes. He has significant experience representing members of the real estate, financial services and technology industries. He has developed a particular expertise in pursuing fraudulent transfer claims on behalf of creditors, and representing lenders in disputes involving intercreditor and loan participation agreements, as well as representing franchisees in major franchise disputes. Mr. Lockett’s practice is national in scope, and he routinely handles cases and arbitrations around the United States.

  • Currently representing multi-national commodities company in dispute with former landlord over disputed common area charges.
  • Currently representing synthetic turf manufacturer in dispute with former customer over breach of an exclusive requirements contract.
  • Currently representing regional bank in lawsuit alleging claims of breach of contract and fraudulent concealment related to a loan participation agreement.
  • Currently representing artist in copyright infringement disputes with multiple multi-national companies.
  • Lead counsel in bench trial for national real estate developer in bench trial involving decade-long dispute with adjoining land owner. Obtained trial victory on all claims.
  • Lead counsel in bench trial for national auto glass manufacturer in dispute with commercial landlord. Obtained trial victory on all claims and award of attorneys' fees and expenses of litigation.
  • Represented private investor who unwittingly invested over $1 million in a Ponzi scheme. Successfully recovered client’s entire investment.
  • Lead counsel for a software company asserting claims for breach of a multi-year earnout provision. The dispute settled for a confidential seven-figure amount in pre-suit mediation.
  • Lead counsel for flagship state university in a dispute with the family of a deceased donor.  Obtained summary judgment for university on all claims.
  • Lead counsel in the representation of a promissory note holder in claims against borrower and guarantors.  Obtained a $25.4 million judgment on the note and guaranty claims, as well as summary judgment on all of the borrower's lender-liability claims.
  • Trial counsel for a Danish manufacturing company and its C.E.O. in a two-week jury trial involving claims of fraudulent transfer and breach of contract. Client obtained a jury verdict of $8.9 million.
