MMM’s Bradley J. Nowak Named Energy & Environmental Trailblazer


Washington, D.C. (April 28, 2015) – The National Law Journal has named Bradley J. Nowak of Morris, Manning & Martin, LLP as an Energy & Environmental Trailblazer. He is one of only 50 attorneys chosen nationwide from hundreds of nominees. The publication notes that the recognition “pays tribute to some of the great minds impacting the crucial intersection of energy production and the environment … as they tackle the challenges of an ever-evolving landscape.”

Nowak represented Prince George’s County, Maryland, on the first-of-its-kind public-private partnership (P3) stormwater infrastructure project in the U.S. The groundbreaking $100 million project, called the Clean Water Partnership, has earned praise from the White House and the EPA. It was developed to satisfy federal Clean Water Act requirements and help restore local waterways and the Chesapeake Bay.

The program is designed to boost local economic development by requiring the use of local, small and minority businesses to construct and maintain the green infrastructure projects. The P3 is expected to have a far-reaching effect on communities throughout the country by being a model for hundreds of municipalities who are subject to similar regulatory mandates and are considering alternative delivery approaches to tackle their stormwater management needs.

Nowak was principally involved in structuring, drafting and negotiating the key project documents, including a Master Program Agreement, which provides the contractual framework governing construction of hundreds of stormwater construction projects, and a 30-year Master Maintenance Agreement for long-term maintenance of such projects. In addition, he advised the county of various project delivery approaches commonly used in P3 projects.
