Classification of Workers: Employees or Contractors

The 2011 Budget for the Department of Labor included an additional $25 million to target the misclassification of workers as independent contractors. This funded an additional 100 enforcement personnel and some state grants to fund enforcement actions and will bring in an estimated $7,000 million in recovered taxes over the next 10 years.

Misclassification of workers can lead to many tax, benefit, and other problems for a business. In view of the additional governmental efforts to investigate in this area, businesses should be prepared for these investigations, and may wish to preliminarily assess their own situations.
