Sameer K. Kapoor is an associate in the firm’s Creditors’ Rights & Bankruptcy and Commercial Litigation Practices.  

Mr. Kapoor concentrates his practice in the areas of creditor representation in commercial bankruptcy cases.  He represents secured, unsecured, and lease creditors protecting their rights and interests in cases and adversary proceedings under Chapters 7, 11, and 13 of the Bankruptcy Code.  He also represents creditors in defending against preference claims brought by debtors and trustees.  Mr. Kapoor has also represented various entities in prosecuting and defending causes of action arising under the Bankruptcy Code, including preferential and fraudulent transfers. 

Additionally, Mr. Kapoor has extensive experience representing lenders in commercial workouts.  He is a member of the firm’s Commercial Real Estate Debt Management Practice, which is dedicated to providing legal support and practical business advice to real estate lenders and owners with respect to their real estate loans.

Prior to joining the firm, Mr. Kapoor was employed at a major U.S. law firm as an associate in its Bankruptcy and Financial Restructuring practice.  He also previously served as a staff attorney in the office of Adam M. Goodman, Standing Chapter 13 Trustee (Atlanta, Georgia), where he represented the Trustee in all cases assigned to The Honorable Margaret H. Murphy, conducted weekly confirmation hearings and section 341 meetings of creditors, and drafted briefs, motions, proposed orders, objections to confirmation, and supplemental reports required to administer a Chapter 13 bankruptcy case.

Representative Matters

  • Represented creditors' committees, trustees, and liquidating agents in major Chapter 11 bankruptcy cases involving bank and insurance holding companies, hospitals, textile and industrial packing manufacturers, automobile retailers, and ponzi-scheme operations.
  • Represented indenture trustees in numerous bankruptcy cases involving bank holding company debtors and the FDIC; researched and analyzed related issues arising under FIRREA.
  • Assisted in the representation of a national jewelry retailer as a debtor in a large Chapter 11 bankruptcy case.
  • Represented secured lenders and landlords in bankruptcy cases, including negotiations and proceedings related to cash collateral issues, motions for relief from stay, section 363 sales, and workout agreements.
