Lisa Wolgast is a partner in the firm’s Creditors’ Rights & Bankruptcy and Corporate & Commercial Litigation Practices. She focuses her practice on creditors’ rights and bankruptcy issues, representing creditors in state and federal court. She regularly handles contested foreclosures, represents creditors in complex workouts, protecting creditors’ rights under Chapters 7 and 11 of the Bankruptcy Code, defends lenders’ liability claims, and represents creditors in defending against preference and fraudulent transfers claims brought by bankrupt debtors and trustees. Ms. Wolgast also represents creditors in pursuit of fraudulent transfer claims against debtors, as well as creditors’ committees in bankruptcy court.
Ms. Wolgast has extensive experience litigating disputes in many areas of the law, including creditors’ rights, bankruptcy, healthcare, telecommunications, accounting negligence, the Fair Credit Reporting Act, securities and general commercial disputes.
Recent Experience
- Representation of lender in foreclosure confirmation and deficiency suit in $30 million loan secured by condominiums and marina located in Putnam County
- Representation of lender in note/guaranty suit resulting in $22 million judgment against obligors
- Representation of lender in connection with appointment of receiver and $10 million note/guaranty suit secured by retail strip center
- Representation of lender in bankruptcy court successfully defeating Debtor’s proposed “dirt for debt” plan of reorganization and successfully converted the case to Chapter
- Representation of creditors in preference and fraudulent transfer claims brought by bankruptcy trustee in Ohio
- Representation of lender in suit involving borrower’s termination of swap termination fee
- Representation of lender in state court, federal court, and bankruptcy court in connection with workout and subsequent bankruptcy related to $2.6 million loan secured by two day care centers
- Representation of creditors committee in bankruptcy proceeding filed by automobile dealer and subsequently represented the liquidating agent post-confirmation in connection with his resolution of claims and claims objections and pursuit of fraudulent transfer claims against the former owner
- Representation of creditor’s committee in bankruptcy proceeding filed by Ponzi scheme operator
- Representation of responsible officer of bankruptcy estate in adversary proceeding against insurer
