Jason Eakes is Of Counsel in the Litigation Practice. Mr. Eakes concentrates his practice on complex commercial litigation, intellectual property, insurance, technology and e-discovery. He represents clients from a broad cross-section of industries, including manufacturing, insurance, government and real estate. Mr. Eakes serves as a resource for attorneys throughout the firm regarding e-discovery and e-data issues in their cases.

Recent Experience

  • Currently advising clients regarding duty of defense, indemnification and other coverage claims in connection with pending lawsuits.
  • Currently representing a municipality in a complex contract dispute with a private contractor involving management and operation of the municipality’s water reclamation systems.
  • Currently representing a large real estate developer, and managing the identification, collection, review and production of voluminous electronic and other documents for use in lawsuits pending in numerous jurisdictions.
  • Recently assisted in coordinating the national discovery process for an international tire manufacturer for product liability lawsuits, including assisting with negotiating and resolving confidentiality orders and discovery disputes, drafting and coordinating complex discovery responses in multiple jurisdictions, and taking steps necessary to preserve the client’s trade secrets from improper discovery.
  • Facilitated and managed the identification, collection, review and production of hundreds of thousands of electronic and other documents for use in complex contract dispute.
  • Acted as lead counsel in the mediation and resolution of a long-running personal injury dispute between an automobile distributor and a dealership employee.
  • Assisted with obtaining partial summary judgment on behalf of a municipality against a private contractor on the contractor’s quantum meruit and other claims.
  • Assisted with obtaining summary judgment on behalf of a plastics manufacturer against claims of patent infringement by a competitor.
  • Assisted with obtaining summary judgment on behalf of an engine manufacturer against claims of trade dress infringement by a competitor.
