MMM Client Arch Systems Successfully Protests Contract Award Ineligibility

Atlanta (August 31, 2018) - Morris, Manning & Martin, on behalf of client Arch Systems, LLC (Arch), successfully protested the arbitrary finding by the U.S. National Institutes of Health Information Technology Acquisition and Assessment Center (NITAAC) that Arch was ineligible for award of a coveted spot on the Chief Information Officer–Solutions and Partners 3 (CIO-SP3) Small Business Government-Wide Acquisition Contract for Historically Underutilized Business Zone businesses. Arch protested NITAAC’s non-award decision arguing that its proposal was not only technically acceptable, but superior to the winning proposals selected by NITAAC.  NITAAC took immediate corrective action in response to Arch’s protest, and a CIO-SP3 contract spot was ultimately awarded to Arch as part of the on-ramp process. This was the second time Arch successfully protested the agency’s decision to withhold award from Arch as NITAAC had previously eliminated Arch from award first in the spring of 2017. In that instance the agency also took corrective action and reinstated Arch in the competition in response to the protest. There are currently 271 contract holders under CIO-SP3 and the contract program has a ceiling of $20 billion.
