Despite Court Rulings Apartment Landlords Advised to Wait on Eviction Proceedings

The U.S. District Court for the District of Columbia recently joined several other federal courts in ruling that the CDC eviction moratorium exceeded the agency's authority. 

As a result, landlords may not want to start eviction proceedings even though the moratorium is set to expire at the end of June. Bonnie Hochman Rothell is advising her clients that they need to stay in a holding pattern if the sole basis for an eviction is failure to pay rent.

Rothell has encouraged several of her landlord clients to be proactive during the moratorium and work with their tenants using creative measures so that there is a structure in place post-moratorium to catch up on the rent.
