Trademark Fundamentals: Selection and Protection of Valuable Marks

Topics of discussion will include the following:

  • What is a Trademark?
    Review basic legal concepts such as likelihood of confusion, descriptiveness, and distinctiveness as well as the process for registering trademarks and the types of trademarks, i.e., word marks, logos, composite marks, colors, etc. Learn how to conduct trademark searches and pick distinctive, protectable terms.
  • Proper Use of Trademarks
    Brands are valuable assets and must be used properly in order to retain their value. Learn how to prevent the demise of a trademark and brand through proper use.
  • Policing and Enforcing Trademarks
    Valuable trademarks must be carefully monitored and protected from infringement, dilution, cybersquatting and other forms of unfair competition. Learn trademark policing strategies, such as use of watch services, Internet searching, and private investigations. We will also review the various forums for enforcing trademarks, including federal and state courts, domain name arbitration proceedings, and Trademark Trial and Appeal Board (TTAB) proceedings.
  • Protecting Brands in the Age of Social Media
    Overview of steps to take to prevent your brand from being misused in online social media such as Facebook and Twitter.
